Importantly, the contributors also explore non-legal judging and judgmentalism, viewing the Victorians as censors and critics in the aesthetic spheres, and within literature \u2013 whether these be the reviewers judging the poetry of the radical Percy Shelley, or the verdicts on criminality in communities offered by popular but \u2018non-canonical\u2019 novelists. How people were judged according to such indices of character as handwriting, is also studied.<\/p>\n<p>But is this <em>judgment<\/em> or <em>judgement<\/em>? You\u2019ll have noticed the previous paragraph avoided making that choice. Our diligent proof reader for Routledge was obviously concerned to standardise the spelling: would we go with the British or the American spelling? From previous experience as a book author, I\u2019d been led to believe the distinction between \u2018judgement\u2019 and \u2018judgment\u2019 according to whether this was American English or British English, and depending on whether it was the sentence passed by the judicial figure or not, was clear cut. But immersion in nineteenth-century texts soon robbed me of that certainty.<\/p>\n<p>Don\u2019t believe what the online lexicographic advisers tell you when they claim a <em>correct<\/em> usage in this instance. Oxford University Press assures us British English users that the \u2018normal spelling in general contexts is judgement. However, the spelling judgment is conventional in legal contexts,\u2019 (<a href=\"https:\/\/en.oxforddictionaries.com\" target=\"_blank\" rel=\"noopener\">https:\/\/en.oxforddictionaries.com<\/a> ). \u2018Judgment\u2019 seems to be the favoured general usage for the <em>Guardian<\/em> today, and was the usage for <em>The Times<\/em> from the 1960s, although the digital archive shows it being applied inconsistently in earlier decades of the century: in the nineteenth-century British newspapers frequently spell it without the \u2018e\u2019 regardless of whether it is being applied in a legal setting, and many other texts make it clear that the Victorians were perfectly happy to spell the word as modern Americans do.<\/p>\n<p>From the titles given to artistic depictions of the final judgment of mankind according to the Christian religion, such as William Blake\u2019s engraving of \u2018The Day of Judgment\u2019 in Blair\u2019s <em>The Grave<\/em>\u00a0 (1813), the many printed sermons, tracts on controversies such as the Judicial Committee of the Privy Council\u2019s verdicts on doctrinal disputes and ritual in the Established church, and manuals on conduct: the spelling of the word as \u2018judgment\u2019 seems to have been widespread during the nineteenth century.<\/p>\n<p>My trusted Chambers\u2019s\u00a0<em>Etymological Dictionary of the English Language<\/em> (a revised edition of 1882) is quite clear on the spelling, if setting up the usual bewildering arrays of meaning:<\/p>\n<p style=\"padding-left: 30px\"><strong>\u00a0<\/strong><span style=\"color: #3366ff\"><strong>Judgment<\/strong>, jujment, n. act of <em>judging<\/em>: the comparing of ideas, to elicit truth: faculty by which this is done, the reason: opinion formed: taste: sentence: condemnation: doom.<\/span><\/p>\n<p>Not every American commentator, after all, had been happy with Webster\u2019s innovations in orthography. One American review of Noah Webster\u2019s quarto<em> Dictionary<\/em> noticed the inconsistency with which the American lexicographer spelled the word, compared with his <em>Spelling Book <\/em>(first published in 1783), alongside similar word formations such as acknowledgement, lodgement and abridgement. (John Pickering, <em>A Vocabulary: Or Collection of Words and Phrases which Have Been Supposed to be Peculiar to the United States of America. To which is Prefixed an Essay on the Present State of the English Language in the United States<\/em>, 1816).<\/p>\n<p>The Cambridge-educated Head Master of the Lower School Collegiate Institution in Liverpool, John Mich\u00f4d, in his London-published work of 1855 claimed:<\/p>\n<p style=\"text-align: left;padding-left: 30px\"><span style=\"color: #3366ff\">If an affix you add, with a <em>consonant starting<\/em>,<\/span><\/p>\n<p style=\"text-align: left;padding-left: 30px\"><span style=\"color: #3366ff\">To a <em>silent<\/em> <strong>e<\/strong> word, with that <strong>e<\/strong> don&#8217;t be parting,<\/span><\/p>\n<p style=\"text-align: left;padding-left: 30px\"><span style=\"color: #3366ff\">EXCEPT in such words as <em>acknowledgment, judgment<\/em>,<\/span><\/p>\n<p style=\"text-align: left;padding-left: 30px\"><span style=\"color: #3366ff\"><em>Duly <\/em>and<em> truly, abridgment <\/em>and<em> lodgment<\/em>.<\/span><\/p>\n<p><em>Orthographic aids; or, Mnemonics for spelling and exercises in derivation<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>And take this, emanating from Melbourne in 1869, from Benjamin Suggit Nayler, \u2018accredited elocutionist to the most celebrated literary societies in London\u2019:<\/p>\n<p style=\"text-align: left\"><span style=\"color: #3366ff\">I wish to grind into dust (under the heel of stubborn facts) the pretensions of Printers to authority in Spelling, <\/span><\/p>\n<p style=\"text-align: left\"><span style=\"color: #3366ff\">and to persuade my readers, if I can, to have recourse to their own judgements!<\/span><\/p>\n<ol style=\"text-align: left\" start=\"130\">\n<li><span style=\"color: #3366ff\">Take this word <em>judgement<\/em>, as an example; How shall we spell it, conformably with the authority of Printers? In Cogan&#8217;s <em>Ethical Questions<\/em>, printed by R. and A. Taylor, it stands <em>judgement<\/em> on p. 17, 47, 113, 114, 116, 124, 162, 209, 220, 224, 292, 297; but, it stands <em>judgment<\/em> on p. 1, 7, 31, 35. 45, 63, 91, 118,143, 150, 165, 179, in the second volume of Johnson\u2019s works, printed by S. and R. Bentley: to which dozen, my readers, shall we give preference? If we look into that <em>critical<\/em> work on our Language, <em>Diversions of Purley<\/em>, printed by R. Taylor, in 1829, we shall find on p. IV, 278, 415, 465 <em>judgement<\/em>, but <em>judgment<\/em> on p. 12, 74, 172, 258; what shall we now do? write the word both ways? surely, both cannot be right!<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><span style=\"color: #3366ff\">Walker\u2019s Aphorism IX (published in 1775) is as plain as it is rational\u2014<\/span><\/p>\n<ol style=\"text-align: left\" start=\"131\">\n<li><span style=\"color: #3366ff\"><em>Ment<\/em> added to words ending with silent <em>e<\/em>, preserve the <em>e<\/em> from elision; as <em>abatement, incitement, chastisement, judgement<\/em>, etc. but, like other terminations, changes the<em> y <\/em>into <em>i<\/em>, when preceded by a consonant ; as <em>accompaniment<\/em>.\u201d<\/span><\/li>\n<\/ol>\n<p style=\"text-align: left\"><span style=\"color: #3366ff\">To this analogical Rule, Lindley Murray most injudiciously made the 5 words abridgment, acknowledgment, argument, judgment, lodgment,<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"color: #3366ff\">Exceptions; nor did Murray ever deviate from Walker\u2019s superior mode of Spelling, without committing a blunder\u2014rely upon this.<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"color: #3366ff\">The reasons assigned by different writers for the <em>unnecessary<\/em> Exceptions they make to general Rules, are <strong>groundless<\/strong>. Murray says of his 5 Exceptions,<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"color: #3366ff\">These deviations have the merit of omitting an unnecessary letter, without altering the pronunciation of the original words;\u201d while \u201cExaminer \u201d Angus, with as little penetration as Murray, tells us, on p. 114,<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"color: #3366ff\">After <em>dg<\/em>, the <em>e<\/em> is generally omitted, as the <em>g<\/em> is made soft by <em>d<\/em>; as <em>judgment<\/em>, <em>abridgment<\/em>:\u201d<\/span><\/p>\n<p style=\"text-align: left\"><span style=\"color: #3366ff\">both of which excuses for countenancing erroneous Spellings, are as <em>false<\/em> as they are silly; neither of them for one instant defensible.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>B.S. Nayler, <em>Commonsense Observations on the Existence of Rules &#8230; Regarding the English Language<\/em>\u00a0(1869)<\/p>\n<p>&nbsp;<\/p>\n<p>Of course, as online discussions of English spelling inform us, the early twentieth-century expert Henry Watson Fowler chose \u2018judgment\u2019 as \u2018older and more reasonable\u2019 and offered plausible grammatical ruling for this.<\/p>\n<p>In the end we plumped for the spelling that was so apparent in the texts of the nineteenth century, and that looked right to an American eye; and though the tendency seems to be go with the spelling without \u2018e\u2019 in British English now, if our usage looks odd to British readers at least it makes the word stand out.
